These Terms of Service ("Terms") govern your use of the website oceaniasmartselect.com.au and any purchase of products from us. By using the site or placing an order, you agree to these Terms.
1. Who we are
The Oceania Smart Select brand, and this website, are operated by XYX Holdings Pty Ltd (ACN 632 303 685, ABN 21 632 303 685), an Australian private company registered in Victoria, Australia. "We", "us", and "our" refer to XYX Holdings Pty Ltd throughout these Terms. You can verify our registration at the Australian Business Register.
2. Products and availability
- We take reasonable care to ensure that product descriptions, images, ingredients, certifications, and prices on this website are accurate at the time of publication. Occasional errors do occur; we reserve the right to correct them and to cancel any order that was placed at an incorrect price, with a full refund.
- Product images are illustrative. Manufacturers periodically update their packaging design, fonts, and label layouts without our control. The actual product packaging is the authoritative source for nutritional, allergen, and ingredient information at the time of purchase.
- Specifications, certifications, and supply-chain information presented on this site are accurate to the best of our knowledge as of the "last verified" date displayed on each product page. Industry standards and certifications can change; we update product pages as we become aware of material changes but do not guarantee real-time accuracy.
- All product prices are in Australian Dollars (AUD) unless stated otherwise, and include GST where applicable under Australian tax law.
- Availability is indicative. If a product becomes unavailable after you order, we will contact you to arrange a refund or alternative within 5 business days.
3. Placing an order
- You place an order by clicking "Buy Now" on a product page, which takes you to a secure Stripe-hosted checkout. Stripe, not our website, processes the payment and card data.
- You must be 18 years or older to place an order.
- A binding contract of sale is formed when we dispatch the product and issue you a shipping confirmation — not when Stripe takes payment. If we cannot fulfil the order, we will refund you in full.
- We reserve the right to refuse or cancel any order at our discretion, including (without limitation) orders that appear fraudulent, breach these Terms, or exceed our reasonable inventory capacity.
4. Payment
- Payments are processed by Stripe Payments Australia Pty Ltd under Stripe's own Terms of Service. We do not store or have access to your credit card details.
- Accepted methods: major Visa, Mastercard, American Express, Apple Pay, Google Pay, and any other method Stripe makes available at checkout.
- If a payment is reversed (chargeback) after goods have shipped, we reserve the right to recover the value of goods, associated shipping costs, and any Stripe chargeback fee.
5. Shipping, returns, and consumer guarantees
Shipping arrangements are described in our Shipping Policy. Return and refund rights, including your rights under the Australian Consumer Law, are described in our Returns & Refunds Policy. Those policies form part of these Terms.
6. Third-party stockists and external listings
- The Where to Buy page lists independent Australian retailers (pharmacies, grocers, supermarkets) that have chosen to stock our products on their own commercial judgement. These retailers operate under their own ABN, set their own pricing, manage their own inventory, and apply their own returns policies.
- We do not control whether a product is on the shelf at any given moment, the price at which the retailer sells it, or any in-store experience. We recommend you call ahead to confirm stock before travelling to a stockist.
- If a stockist relationship ends, we update the page; we make no guarantee of real-time accuracy and accept no liability for a wasted journey based on outdated listings.
- Online marketplace listings (e.g. eBay Australia) link to third-party search results we do not control. Prices, sellers, and authenticity on those platforms are governed by the marketplace operator and the individual seller.
7. Intellectual property
- All content on this site — including text, images, graphic design, logos, and JSON-LD structured data — is © XYX Holdings Pty Ltd or licensed from our brand partners (OCEANIA GOLD, Otway Pure, G&M Australian Creams, EAORON, Thera Lady, Manumax) under their respective licences.
- Third-party brand names and logos are the property of their respective owners and used under nominative fair use to describe products and their origin.
- You may not copy, republish, or use our content for commercial purposes without our written permission.
8. User conduct
You must not: attempt to disrupt the site, probe for vulnerabilities, misuse our forms, submit false information, or use the site for any unlawful purpose. We may block access at our discretion.
9. Third-party links
The site links to third-party services (Google Analytics, Cloudflare, Stripe, Australia Post tracking, gs1.org verification, abr.business.gov.au, Google Maps, FormSubmit, WhatsApp, etc.). We do not control those services and are not responsible for their content or availability.
10. Disclaimers and limitation of liability
- To the fullest extent permitted by law, we exclude liability for indirect, consequential, or special loss arising out of use of the site.
- Nothing in these Terms excludes, restricts, or modifies the consumer guarantees under the Australian Consumer Law or other rights you may have as a consumer which cannot lawfully be excluded.
- Educational content (Insights articles, Glossary, brand stories, FAQ). These pages are written for general education and reflect information available at the time of writing. They are not medical, dietary, financial, or legal advice. Industry standards, scientific consensus, certifications, and regulations evolve over time. For decisions affecting your health, business, or compliance, consult a qualified professional and verify with the original authoritative sources we cite.
- Skincare and dietary product claims are presented in good faith from publicly available scientific and regulatory sources. Skin reactions and dietary tolerances are individual; discontinue use and consult a healthcare professional if any product causes adverse effects.
11. Privacy and cookies
Your personal information is handled under our Privacy Policy. Cookie usage is described in our Cookie Policy. By using the site you consent to those policies.
12. Governing law and jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia. Any dispute arising is subject to the exclusive jurisdiction of the courts of Victoria and the federal courts of Australia, without prejudice to your statutory rights as a consumer in your country of residence.
13. Changes
We may update these Terms. The "Last updated" date above shows the current version. Material changes affecting your rights will be notified via a banner on the home page for at least 30 days.
